  1. END-USER LICENSE AGREEMENT
  2. PLEASE READ CAREFULLY.
  3. BY USING THIS SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF
  4. THIS LICENSE.  IF YOU DO NOT AGREE TO THESE TERMS, PROMPTLY RETURN
  5. THE PRODUCT IN ITS PACKAGING TO THE PLACE WHERE YOU OBTAINED IT.
  6. 1. License.  The software accompanying this license (the "Software") and the
  7.    related documentation are licensed to you by us and are subject to this license.
  8.    If the Software is configured for loading onto a hard drive, you may so load the
  9.    Software only onto the hard drive of a single computer and run the Software off
  10.    only that hard drive.  You may not delete the copyright notices or any other
  11.    proprietary legends on the original copy of the Software.  You may transfer all
  12.    rights we grant to you in this license to someone else as long as he or she
  13.    reads and agrees to accept this license.
  14. 2. Restrictions.  The Software contains copyrighted material, trade secrets and
  15.    other proprietary material.  You may not decompile, modify reverse engineer,
  16.    disassemble or otherwise reproduce the Software except as expressly allowed
  17.    by us.  You may not rent, lease, sublicense or distribute the Software.  You
  18.    may not electronically transmit the Software from one computer to another or
  19.    over a network.
  20. 3. Termination.  This License is effective until terminated.  You may terminate
  21.    this License at any time by destroying the Software and related documentation.
  22.    This License will terminate immediately without notice from us if you fail to
  23.    comply with any provision of this license.  Upon termination, you must destroy
  24.    the Software and related documentation.
  25. 4. Disclaimer of Warranty on Software.  You are aware and agree that use of the
  26.    Software and the media on which it is recorded is at your sole risk.  The
  27.    Software, related documentation and the media are provided "AS IS." Unless
  28.    otherwise provided by applicable law, Playmates Interactive Entertainment Inc.
  29.    ("PIE") warrants to the original purchaser of this product that the Software
  30.    storage medium will be free from defects in material and workmanship under
  31.    normal use for ninety (90) days from the date of purchase.  This warranty is
  32.    void if the defect has arisen through accident, abuse, neglect or
  33.    misapplication.  PIE EXPRESSLY DISCLAIMS ALL
  34.    OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED
  35.    TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
  36.    A PARTICULAR PURPOSE.  PIE DO NOT WARRANT THAT THE FUNCTIONS
  37.    CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, NO ORAL
  38.    OR WRITTEN INFORMATION OR ADVICE GIVEN BY PIE OR ANY OF PIE'S
  39.    AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY
  40.    WAY INCREASE THE SCOPE OF THIS WARRANTY.  SOME JURISDICTIONS
  41.    DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE
  42.    EXCLUSIONS MAY NOT APPLY TO YOU.
  43. 5. Limitation of Liability.  UNDER NO CIRCUMSTANCES, INCLUDING
  44.    NEGLIGENCE, SHALL PIE BE LIABLE FOR ANY INCIDENTAL, SPECIAL
  45.    OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY
  46.    TO USE THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF PIE HAS
  47.    BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.  SOME
  48.    JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF
  49.    LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE
  50.    LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.  In no event
  51.    shall PIE's total liability to you for all damages, losses,
  52.    and causes of action (whether in contract, tort or otherwise)
  53.    exceed the amount paid by you for the Software.
  54. 6. Controlling Law and Severability.  This license shall be governed by and
  55.    construed in accordance with the laws of the State of California, USA.  If
  56.    any provision of this license is unenforceable,  the rest of it shall remain
  57.    in effect.
  58. 7. Complete Agreement.  This license constitutes the entire agreement between
  59.    the parties with respect to the use of the Software and the related
  60.    documentation.
